V Interdepartmental Scientific and Practical Conference "Criminal and Operational-Search Legislation: Problems of Intersectoral Relations and Prospects for Improvement"

On November 15, 2019, an interdepartmental scientific and practical conference “Criminal and operational-search legislation: problems of intersectoral relations and prospects for improvement” was held at the Moscow University of the Ministry of Internal Affairs of Russia named after V.Y. Kikot.

The conference was attended by representatives of educational and research institutions, practical law enforcement officers, faculty, cadets, students and adjuncts of the University.

The conference was opened by the Deputy Head of the Moscow University of the Ministry of Internal Affairs of Russia named after V.Y. Kikot for Scientific Work, Candidate of Legal Sciences, Police Colonel V.Y. Fedorovich. Vasily Yurievich welcomed the audience and noted that the discussion of the problems of improving intersectoral relations of criminal and operational-search legislation is extremely important and relevant for increasing the effectiveness of combating crime.

A lively discussion of the scientific community was caused by the report of Professor of the Department of Criminal Law of the Moscow University of the Ministry of Internal Affairs of Russia named after V.Y. Kikot, Doctor of Law, Associate Professor of Police Colonel G.S. Shkabin on the topic “Postmodernism of intersectoral relations of criminal law and operational-search activities”. In his speech, Gennady Sergeevich considered the problems and ways to improve intersectoral links of criminal law and operational-search activities.

President of the Guild of Russian Lawyers, Rector of the Russian Academy of Advocacy and Notaries, Honored Lawyer of the Russian Federation, Doctor of Law, Professor G.B. Mirzoev in his speech considered in detail the problem of provocation of crimes and possible countermeasures. Hasan Borisovich drew the attention of the forum participants to the fact that this problem is important not only for practical employees, but also for theorists – scientists who are able to consecrate this problem in their works and formulate a number of recommendations for its minimization.

The topic of the development of the theory of lawful harm in criminal law (circumstances precluding the criminality of an act) in the decisions of the highest judicial bodies of the country was touched upon in his report by the chief researcher of the Department of Criminal and Criminal Procedure Legislation, The Judicial System of the Institute of Legislation and Comparative Law under the Government of the Russian Federation, Honored Lawyer of the Russian Federation, Doctor of Law, Professor V.I. Mikhailov.

The conference also addressed the issues of criminal legal assessment of provocative actions in the implementation of operational and investigative activities, a systematic approach to improving the legal regulation of operational search activities, countering the use of cellular communication channels in institutions of the penitentiary system of Russia, the criminal law significance of the danger factor of a convict with a mental disorder that does not exclude sanity, when organizing operational-search activities in correctional institutions, the problems of targeted operational-search prevention against persons exposed to the influence of the ideology of terrorism and extremism and many others.
